Is it mandatory to insure an electric bicycle in Spain in 2026?

Insurance, registration, and licensing for an e-bike: what the law actually requires

The short answer is no: a conventional pedal-assist electric bicycle does not require mandatory insurance in Spain.

To qualify, it must meet three conditions:

  • Have a motor with a maximum continuous rated power of 250 W.
  • Provide assistance only while pedaling.
  • Progressively cut off assistance before reaching 25 km/h.

These bicycles, legally known as EPAC or pedelec, are excluded from the category of light personal vehicles subject to mandatory insurance. They also do not need to be registered or entered in the DGT personal mobility vehicle registry.

What has actually changed in 2026?

The new requirement primarily affects personal mobility vehicles, such as electric scooters. Since the implementation of the registry regulated by Royal Decree 52/2026, these vehicles must be registered with the DGT as a prerequisite for obtaining mandatory insurance. Electric bicycles that comply with EPAC regulations are exempt from this requirement and retain their legal status as bicycles.

Why is an e-bike not a VMP?

The main difference lies in how the motor operates. In an EPAC electric bicycle, the motor assists the rider’s effort: if you stop pedaling, assistance stops. In a VMP, the motor directly propels the vehicle without the need for pedaling.

When does an e-bike stop being considered a bicycle?

An electric bicycle loses its legal status as an EPAC when it fails to meet one of its essential requirements. For example:

  • The motor continues to assist above 25 km/h.
  • It can move using a throttle without pedaling, except for the legally permitted walk-assist function.
  • Its power or technical specifications exceed the limits established for a pedal-assist bicycle.

This does not mean it automatically becomes a VMP. Depending on its characteristics and homologation, it may be classified as a motor cycle or a moped.

What about speed pedelecs?

Speed pedelecs can assist pedaling up to 45 km/h and are generally classified as mopeds in category L1e-B. To ride legally, they require:

  • Homologation and registration.
  • Mandatory insurance.
  • AM or B driving license.
  • Approved helmet.
  • Equipment and documentation required for a moped.

Additionally, they cannot ride on bike lanes, sidewalks, greenways, or pedestrian areas. They must use the roadway and comply with the rules applicable to mopeds.

What happens if an electric bicycle is modified or the speed limiter is removed?

Modifying an e-bike so that it continues to assist above 25 km/h or installing a throttle that allows riding without pedaling can cause it to lose its EPAC homologation. In that case, it can no longer legally ride on public roads as a conventional bicycle. Tampering can also result in:

  • Loss of warranty on the affected components.
  • Vehicle immobilization and possible fines.
  • Problems with insurance coverage in the event of an accident.
  • Increased risk, as brakes, tires, and other components may not be designed for those performance levels.

Frequently asked questions about electric bicycle insurance

  1. Do I have to insure a 250 W electric bicycle? No, as long as the motor only operates while you pedal and stops assisting before reaching 25 km/h.
  2. Do I need to register or license my electric bicycle with the DGT? No. Bicycles that comply with EPAC regulations do not require registration and are excluded from the VMP registry.
  3. Can I purchase insurance even if it’s not mandatory? Yes. Voluntary insurance can include liability, theft, accidental damage, roadside assistance, or legal defense. Before purchasing, it’s worth checking whether your home insurance already provides any of these coverages.
  4. What happens if I remove the speed limiter from my electric bicycle? It may no longer be considered a legal bicycle and become a non-homologated vehicle for public road use. It can also affect the warranty and insurance coverage.
